On July 23rd 2013, the ORGANIZED WORKERS’ UNION OF THE NATION’S GENERAL ATTORNEY’S OFFICE –STOPGN-, member of the GUATEMALAN UNION, INDIGENOUS AND PEASANT MOVEMENT –MSICG- presented a collective conflict of social economic nature before the Labor and Social Prevision Courts against the Nation’s General Attorney’s Office, VLADIMIR OSMAN AGUILAR GUERRA, to negotiate the Collective Agreement of Labor Conditions with the Majority Union.MSICG regrets that the Nation’s General Attorney, Dr. VLADIMIR OSMAN AGUILAR GUERRA, legal representative of the State of Guatemala, in charge of the legal defense of the various State institutions, in practice shows a position that’s contrary to respecting the fundamental right to collective negotiation, and it calls upon him to reflect and take into account that the defense of the State cannot be undertaken based upon contradictions, delays or refusals in complying with the duties of respecting the very rights that this State is obliged to enforce.MSICG hopes that the right to collective negotiation of its affiliate, STOPGN, finds an effective guarantor of its full positive nature in the labor justice system, despite the fact the Advisor assigned by the Nation’s General Attorney, JUAN CARLOS CORONA LOPEZ, in the light of Agreement 27-2009 of the Supreme Court of Justice, has been appointed Substitute Magistrate of the First Court of Appeals of Labor and Social Prevision, against whose permanent members MSICG has promoted a complaint for possible committing at least 8 crimes with the intention of denying the workers unionizing right.Guatemala, July 23rd 2013. Today, July 3rd 2013, the Guatemalan Union, Indigenous and Peasant Movement –MSICG- started a training cycle aimed to strengthen the knowledge of its different levels of leadership on the situation of social exclusion in the country and the inefficiency of public policies to guarantee the solution of its main causes.The goal of this cycle is to reaffirm the need of approaching unionism from a new perspective, so its positions can go beyond the limited scope of guild expectations, leading the social interlocution of unionism towards becoming a transformation tool for society, turning unions into positive, proposing actors with incidence, for the promotion of a true process of democracy and social justice building.In this sense, and having clarity regarding the decisive role of fiscal policy to promote development, it has been important for MSICG to move forward in the understanding of its integral reaches, and that is why the subject that has been chosen to begin this process was FISCAL POLICIES AND DEVELOPMENT FINANCING, which was developed by the companions of the CENTRAL AMERICAN INSTITUTE OF FISCAL STUDIES –ICEFI- who shared their specialized knowledge on this subject, clarified MSICG’s leaders’ doubts and made a priceless contribution to MSICG’s strategic approach.MSICG deeply thanks the Central American Institute of Fiscal Studies –ICEFI-, and especially companion Jonathan Menkos Zeissig, Executive Director of ICEFI and companions Candy Morales and Ricardo Barrientos for the support they provided for the organization and development of this activity, which was quite positively evaluated by MSICG’s different levels of leadership,…

Today, Monday June 24th 2013, the UNION OF DOMESTIC WORKERS OF GUATEMALA –SINTRACAPGUA, for their initials in Spanish-, a union affiliated to the Guatemalan Union, Indigenous and Peasant Movement –MSICG-, together with MSICG had a meeting with JUAN DE DIOS DE LA CRUZ RODRIGUEZ LOPEZ, Chairman of the Board of IGSS, to manifest to him their concern for the precarious labor conditions of more than 187,000 domestic workers in Guatemala, most of whom are women, indigenous and minors.The Secretary General of SINTRACAPGUA, MARIA OLIMPIA CRUZ LOPEZ, reminded him that, as she denounced it in due time, during the REYES MAYEN administration, as an act of mockery to domestic workers, Agreement 1235 of the Board of IGSS was issued, regulating the special protection program for domestic workers –PRECAPI-.PRECAPI was conceived more as a mechanism of mediatized character tan as a solution to the precarious labor conditions of this important sector of society and, as a result, its coverage was restricted to the department of Guatemala, with limited Access to maternity, accidents and healthy child control programs. El día de hoy, lunes 24 de junio de 2013, EL SINDICATO DE TRABAJADORAS DE CASA PARTICULAR DE GUATEMALA –SINTRACAPGUA-, sindicato afiliado al MOVIMIENTO SINDICAL, INDÍGENA Y CAMPESINO GUATEMALTECO –MSICG- y el MSICG sostuvieron una reunión con el Presidente de Junta Directiva del IGSS Licenciado JUAN DE DIOS DE LA CRUZ ROGRIGUEZ LÓPEZ para manifestarle su preocupación por la precarización de las condiciones laborales de las más de 187,000 trabajadoras que se desempeñan como trabajadoras de casa particular en Guatemala, la mayoría de las cuales además son mujeres, indígenas y menores de edad.La Secretaria General del SINTRACAPGUA, MARIA OLIMPIA CRUZ LÓPEZ recordó tal y como lo denunció en su momento que durante la administración de REYES MAYÉN en un acto de burla a las trabajadoras de casa particular se emitió el Acuerdo 1235 de Junta Directiva del Instituto Guatemalteco de Seguridad Social que Reglamento el programa especial de protección para trabajadoras de casa particular –PRECAPI-. El PRECAPI, se concibió más como un mecanismo de carácter mediático que como una solución a la precaria situación laboral de este importante sector de la sociedad y, como producto de ello, su cobertura se restringió al departamento de Guatemala y con un acceso limitado a los programas de maternidad, accidentes y control del niño sano. El día 9 de junio de 2013, el Movimiento sindical, indígena y campesino Guatemalteco –MSICG- y el Centro de Estudios y Apoyo al Desarrollo Local –CEADEL- lanzaron a la vida sindical el sindicato denominado: CENTRAL DE TRABAJADORES DE LA INDUSTRIA DE LA MAQUILA DE GUATEMALA –CENTRIMAG-. On June 9th 2013, the Guatemalan Union Indigenous and Peasant Movement –MSICG- and the Center for the Study and Support of Local Development –CEADEL- launched into life the union called: CENTRAL OF THE MAQUILA INDUSTRY WORKERS OF GUATEMALA –CENTRIMAG-.This is the first union of the maquila industry in the country’s history, and by launching it, MSICG and CEADEL expect to improve the precarious labor conditions that maquila workers face, which in many cases equal forced labor.The formation of this new union within the structure of MSICG is part of the strategy of transformation of unionism in Guatemala, and another step in leaving the company unions behind as an element of dispersion and weakening of union struggles. El día de hoy 14 de junio de 2013 el Sindicato de trabajadores administrativos y de servicio de la Educación de Guatemala –STAYSEG- y el Sindicato de trabajadores de las Direcciones departamentales del Ministerio de Educación del Estado de Guatemala –SITRADEMEG- con el apoyo de su Central Sindical, el Movimiento sindical, indígena y campesino Guatemalteco –MSICG- plantearon un conflicto colectivo de carácter económico social ante los tribunales de trabajo y previsión social en contra del Estado de Guatemala a través de la entidad nominadora, Ministerio de Educación. Estas acciones serán proseguidas por otras de carácter legal tendientes a lograr la reinstalación de dos directivos sindicales despedidos como parte de la estrategia del Ministerio de Educación de debilitar a los sindicatos, luego de que plantearan la negociación en la vía directa e imponer la interlocución de una organización sindical bajo el control patronal y de un gremio distinto al administrativo.El proyecto de pacto busca mejorar las precarias condiciones de trabajo de miles de trabajadoras y trabajadores del gremio administrativo del Ministerio de Educación, que en una buena parte devengan salarios inferiores al salario mínimo, que son forzados bajo amenaza de despido a trabajar más allá de la jornada de trabajo sin su consentimiento previo y sin la respectiva remuneración, que son sometidos a relaciones laborales simuladas y a través de la cual se pretende lograr su docilidad hacia tales condiciones laborales mediante la inestabilidad laboral y privación de la posibilidad de organizarse sindicalmente así como negar a las trabajadoras los derechos…
